End User License Agreement

This End User License Agreement ("EULA") is between you and Caridad Studios LLC ("Caridad Studios", "we", "us"). It covers the Fammit application software for iPhone, iPad and Android, the web app and the wall display (the "App"). It's part of the Fammit Terms of Service, and the definitions there apply here. By installing or using the App, you agree to this EULA.

1. The license

Subject to this EULA and the Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the App for your household's personal, non-commercial use on devices that you own or control, including shared household devices, wall displays and tablets you set up for your family. For the iPhone and iPad app, this includes use by other accounts associated with you through Apple Family Sharing or volume purchasing, as Apple's Usage Rules permit.

2. What you may not do

Except where the law expressly allows it, you may not:

• copy, modify, translate or create derivative works of the App;
• decompile, disassemble, reverse engineer or try to extract the App's source code;
• rent, lease, lend, sell, sublicense, distribute or otherwise make the App available to anyone outside your household;
• remove or alter any proprietary notices in the App;
• get around any technical limits, parent controls or security features in the App; or
• use the App to build a competing product or service.

3. Updates

We may provide updates to the App through the App Store, Google Play or directly over the air. Updates may add, change or remove features and may install automatically. This EULA covers all updates unless an update comes with its own terms.

4. Ownership

The App is licensed, not sold. Caridad Studios and its licensors own the App and all intellectual-property rights in it. The App includes open-source components that are licensed under their own terms, which govern your use of those components.

5. Your content and privacy

Content your household puts in the App is yours, as the Terms explain. How we handle personal information, including children's, is described in the Privacy Policy and the Children's Privacy Notice.

6. Ending the license

This license lasts until it ends. You can end it at any time by deleting the App from your devices. It ends automatically if you break this EULA or the Terms. When it ends, you must stop using the App and delete it.

7. Warranty, liability and disputes

The disclaimers, limitation of liability, governing law and dispute-resolution provisions of the Terms (sections 15 through 20, including the arbitration agreement and class action waiver) apply to this EULA.

8. Export

You may not use or export the App in violation of U.S. law or the laws of the place where you got it. You confirm that you're not located in a country subject to a U.S. government embargo or designated as "terrorist supporting", and that you're not on any U.S. government list of prohibited or restricted parties.

9. Apps from Apple's App Store

If you got the App from Apple's App Store, the following also apply, and override anything in this EULA or the Terms that conflicts with them:

• Acknowledgement. This EULA is between you and Caridad Studios only, not with Apple Inc. ("Apple"). Caridad Studios, not Apple, is solely responsible for the App and its content.
• Scope of license. The license granted to you is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
• Maintenance and support. Caridad Studios is solely responsible for providing any maintenance and support for the App, as described in this EULA or as required by law. Apple has no obligation to provide any maintenance or support for the App.
• Warranty. Caridad Studios is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Caridad Studios' responsibility, to the extent not disclaimed.
• Product claims. Caridad Studios, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the App's use of the HealthKit and Screen Time frameworks.
• Intellectual property. If a third party claims that the App or your possession and use of it infringes that third party's intellectual-property rights, Caridad Studios, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
• Developer name and address. Questions, complaints or claims about the App go to: Caridad Studios LLC, 1475 E Waterfall Way, Fruit Heights, UT 84037, (801) 436-7768, [email protected].
• Third-party terms. You must comply with any applicable third-party terms when using the App, such as your wireless data service agreement.
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and on your acceptance of it, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

10. Apps from Google Play

If you got the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this EULA and isn't responsible for the App.
