Terms of Service
Effective October 2, 2026 · Version 2026-10-02
Please read these terms carefully. They include a binding arbitration agreement and a class action waiver in section 20, which affect how disputes between you and us are resolved. You can opt out of arbitration within 30 days, as explained there.
These Terms of Service ("Terms") are an agreement between you and Caridad Studios LLC, a Utah limited liability company ("Caridad Studios", "we", "us" or "our"), about your use of Fammit: the Fammit app for iPhone, iPad and Android, the web app at fammit.app, the wall display and home-screen widgets, and the related websites and services (together, "Fammit" or the "Service"). The End User License Agreement, the Privacy Policy and the Children's Privacy Notice are part of these Terms.
By creating a family, accepting these Terms in the app, or using Fammit, you agree to these Terms. If you don't agree, don't use Fammit.
1. Who can use Fammit
- Account holders are adults. A family ("household") in Fammit is created and managed by an adult who is at least 18 years old and who is a parent or legal guardian of any children they add, or who has that parent's or guardian's permission ("Account Holder"). Fammit asks for your date of birth before setup to confirm this. Don't give a false date of birth.
- Other grown-ups. An Account Holder can add other adults to the household (a co-parent, a grandparent who lives there, a caregiver). Each adult who uses Fammit agrees to these Terms for themselves the first time they sign in.
- Children use Fammit through their family. Children, including children under 13, may use Fammit only as members of a household that their parent or legal guardian has set up, and only with that parent's or guardian's permission and supervision. Children don't create their own accounts. See section 3 and the Children's Privacy Notice.
- You may not use Fammit if you're barred from doing so under the laws that apply to you, or if we've previously ended your access.
2. Your household and account
- Sign-in. The Account Holder signs in with an email address and password (or another sign-in method we offer). Each household member has a four-digit PIN for signing in on a shared device. You're responsible for keeping your password and PINs confidential and for everything that happens in your household, including what members and connected relatives do there.
- Parent controls. Grown-ups ("parents" in the app) control the household: who's in it, what each member can do, what's shared with relatives, which screens and widgets are paired, and what's connected. Some settings are protected by a parent PIN. Keep it away from children.
- Accurate information. Keep your email address current so we can reach you about your account, security and changes to these Terms.
- Connected households. You can connect with other households (for example, grandparents) and choose what they see. A connected household sees what you share, under their own account and these Terms. You can disconnect at any time.
- Shared devices and displays. If you use Fammit on a shared device, wall display or home-screen widget, information on it can be seen by anyone near it. You decide where screens go, what they show and what they're allowed to do (for example, marking chores or adding to the shopping list). Revoke a screen in the app if a device is lost or given away.
3. Children and parental responsibility
- Your consent. When you add a child to your household, you confirm that you're their parent or legal guardian (or have that person's permission), and you consent to our collecting, using and disclosing the child's information as described in the Children's Privacy Notice. You can review or delete your child's information, refuse further collection, or withdraw your consent at any time, as that notice explains.
- Supervision. You're responsible for supervising your children's use of Fammit, including what they post in the family feed, what they share with connected relatives, how they use the assistant, and any purchases or redemptions they make in the family's rewards store.
- No direct marketing to children. We don't show advertising in Fammit and don't market to children.
- Teens. A household member aged 13 to 17 uses Fammit under the same parental supervision. They can't become an Account Holder until they're 18.
4. Plans, subscriptions and payments
Fammit is free to use today. If we offer paid plans, these terms apply when you buy one:
- Where you pay. Purchases in the iPhone or iPad app are made through Apple's App Store, and in the Android app through Google Play, under their terms. If we offer purchases on the web, the price, billing period and payment processor are shown before you pay.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends. You can cancel in your App Store or Google Play account settings. Cancelling stops future renewals; it doesn't refund the current period, and your plan stays active until the period ends.
- Free trials. If a plan includes a free trial, you'll be charged when the trial ends unless you cancel before then.
- Refunds. Refunds for App Store and Google Play purchases are handled by Apple and Google under their policies. For purchases made directly with us, we'll consider refund requests where the law requires it or where something went wrong on our side.
- Price changes. We'll tell you in advance if a subscription price changes, and you can cancel before it takes effect.
- Household plans. A paid plan applies to the household that bought it. Features may differ between plans, and we may change what's included in a plan with notice.
5. Allowance, rewards and money features
- Allowance, chore earnings, balances, giving, goals and the rewards store in Fammit are a record your family keeps. Fammit is not a bank, money transmitter, payment service or financial adviser. Fammit doesn't hold, move, invest or pay out real money.
- If you pay a child, cash out a balance or give a gift, you do that outside Fammit (for example, in cash or through a payment app like Venmo), between your family members and under that service's terms. We're not responsible for those payments.
- Balances and records in Fammit may contain errors. Check them before relying on them.
6. Your content
- It's yours. What your household puts in Fammit (events, chores, routines, goals, meals, recipes, lists, posts, comments, photos, videos, messages to the assistant and the rest) is "Your Content", and you keep your rights in it.
- Our permission to use it. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display and adapt Your Content only as needed to operate, secure and improve Fammit for you and the people you share with. This license ends when Your Content is deleted from Fammit, except for copies in backups for a limited time and anything we must keep by law.
- Your responsibility. You confirm you have the right to share Your Content, and that it doesn't infringe anyone's rights or break any law. You're responsible for content your children post.
- We don't sell it. We don't sell Your Content or use it for advertising. See the Privacy Policy.
7. Acceptable use
Don't use Fammit, or let anyone in your household use it, to:
- post content that is unlawful, harassing, hateful, sexually explicit, violent, or that exploits or endangers children;
- collect information about people who haven't agreed, or impersonate anyone;
- access another household's information, accounts or devices without permission;
- probe, scan, overload or interfere with Fammit or its security, or get around rate limits, feature limits or parent controls;
- copy, scrape, resell or build a competing product from Fammit, or reverse engineer it except where the law allows;
- send spam or bulk email to a household's email-in address; or
- use Fammit for any commercial purpose other than running your own household.
We may remove content or suspend access that breaks these rules, and we'll report apparent child sexual abuse material and threats to life to the authorities as the law requires.
8. AI features
Fammit includes features powered by artificial intelligence: the assistant, reading recipes, invitations and schedules from photos, reading dates from emails sent to your household's address, checking profile photos, and creating artwork. When you use them:
- What you send to the feature (your message, the photo or email, and the household context it needs) is processed by our AI service providers, as described in the Privacy Policy.
- AI can be wrong. Check anything that matters (dates and times, ingredients and allergens, quantities, health, safety or money) before relying on it. AI output isn't professional advice.
- Parents control who in the household can use the assistant and how much, in Settings.
- Don't use AI features to create harmful, deceptive or unlawful content.
9. Health, activity and screen time
- If a member turns on health sync, Fammit reads activity totals (like steps) from Apple Health or a similar service to update goals. Fammit is not a medical device and doesn't give medical advice.
- App blocking and screen-time features rely on the device's operating system. They can be turned off, fail or be worked around, and aren't a substitute for supervision.
10. Calendars, location, drive times and weather
- Calendar sync, drive times, "leave by" reminders, weather and what-to-wear suggestions are estimates from third-party services and can be wrong or late. Don't rely on them where safety is at stake.
- Never use Fammit in a way that distracts you while driving.
10a. Text messages
- Fammit texts. A grown-up who links their mobile number (Settings › You › Text Fammit, confirmed with a code we text to it) agrees to receive texts from Fammit: that code, replies to what they text us (things added to the family's list or calendar), and, only if they choose it, a morning agenda. A guest whose number a host enters gets that host's event invitation, our replies to their answer, one reminder the evening before and the host's updates about that event.
- Message frequency varies. Message and data rates may apply. Reply STOP to any of our texts to stop them, and HELP for help, or write to [email protected]. Agreeing to texts isn't a condition of any purchase.
- Texts work with US and Canadian mobile numbers. Carriers aren't liable for delayed or undelivered messages.
- How we handle phone numbers is in our Privacy Policy. We don't share them, or anyone's consent to receive texts, with third parties for their marketing.
11. Other services, shopping and affiliate links
- Fammit connects to services run by others (Google Calendar, iCloud, Outlook, Kroger-family stores, Apple Health and more). Your use of them is governed by their terms and privacy policies, and we're not responsible for them.
- When Fammit adds items to a store cart, you review and buy them in that store's app. Prices, availability, product matches and orders are the store's and may be wrong or out of date.
- Some links to stores carry an affiliate tag, so we may earn a commission if you buy, at no extra cost to you. As an Amazon Associate, Caridad Studios earns from qualifying purchases.
12. Our property and the app license
Fammit, including its software, design, text, graphics, logos and the "Fammit" name, belongs to Caridad Studios and its licensors and is protected by intellectual-property laws. Your right to use the app is set out in the End User License Agreement. Except for that license, these Terms don't give you any rights in Fammit.
Feedback. If you send us ideas or suggestions, we can use them without obligation to you.
Copyright complaints. If you believe content in Fammit infringes your copyright, write to us at the address in section 23 with the information required by the Digital Millennium Copyright Act.
13. Changes to Fammit
We're always improving Fammit, and we may add, change or remove features, including features of a paid plan, with reasonable notice where a change takes away something you rely on. The app updates itself, including over-the-air updates that don't go through an app store; keeping it updated is a condition of using it.
14. Ending your use
- You can stop using Fammit at any time. An Account Holder can have the household and its content deleted by writing to us from the account's email address; see the Privacy Policy for what's deleted and when.
- We may suspend or end your access if you break these Terms, if required by law, or to protect Fammit, its users or others. Where reasonable, we'll tell you first and give you a chance to fix the problem and to download your photos.
- If we discontinue Fammit, we'll give at least 30 days' notice and a way to export your photos, and we'll refund any prepaid fees for the unused period of plans bought directly from us.
- Sections 5, 6 (as to content already shared), 12 and 15 through 22 survive the end of these Terms.
15. Disclaimers
FAMMIT IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, CARIDAD STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT FAMMIT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE OR ACCURATE, THAT REMINDERS OR NOTIFICATIONS WILL BE DELIVERED, OR THAT DATA WILL NEVER BE LOST. Some places don't allow these exclusions, so some of them may not apply to you.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CARIDAD STUDIOS AND ITS MEMBERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, MISSED EVENTS, APPOINTMENTS, CHORES, PAYMENTS OR PURCHASES, ARISING OUT OF OR RELATING TO FAMMIT OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO FAMMIT IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR FAMMIT IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR US $50. These limits don't apply to liability that can't be limited by law, including for gross negligence or willful misconduct where the law doesn't allow limiting it.
17. Indemnity
To the extent the law allows, you'll defend and hold Caridad Studios harmless from third-party claims, and related losses and reasonable costs, arising from Your Content, your household's misuse of Fammit, or your breaking these Terms or the law.
18. Governing law
These Terms are governed by the laws of the State of Utah and applicable U.S. federal law, without regard to conflict-of-laws rules. Nothing in these Terms takes away rights you have under the consumer-protection laws of the place where you live that can't be waived by contract.
19. Talk to us first
Most problems can be fixed quickly. Before starting arbitration or a court case, you and we each agree to try to resolve the dispute informally for at least 60 days after one of us sends the other a written notice describing it. Send yours to the address in section 23.
20. Arbitration agreement and class action waiver
- Arbitration. If we can't resolve a dispute informally, you and Caridad Studios agree that any dispute, claim or controversy arising out of or relating to Fammit or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration may be held by video, by phone, on written submissions, or in the county where you live. Payment of filing fees will follow the AAA's rules, and we'll pay any additional fees required for the arbitration to be fair to a consumer. The Federal Arbitration Act governs this section.
- Exceptions. Either of us may bring an individual claim in small-claims court if it qualifies, and either of us may ask a court for an injunction to stop infringement or misuse of intellectual property.
- No class actions. You and we each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims of different people.
- Mass filings. If 25 or more similar demands are filed against us by or with the help of the same counsel, they'll be administered in batches under the AAA's mass arbitration rules.
- Opting out. You can opt out of this arbitration agreement by emailing [email protected] within 30 days after you first accept these Terms, with your name, your household's email address and a clear statement that you opt out of arbitration. Opting out doesn't affect anything else in these Terms.
- If this section doesn't apply. If you opt out, or if this section is found unenforceable, disputes will be resolved exclusively in the state or federal courts in Salt Lake County, Utah, and you and we consent to their jurisdiction, except where the law of the place you live requires otherwise.
21. Changes to these Terms
We may update these Terms. If a change is material, we'll tell you in the app or by email before it takes effect, and the Account Holder and other grown-ups will be asked to accept the new version before continuing to use Fammit. The version and effective date at the top show which Terms apply. Changes won't apply to disputes that arose before the change.
22. General
- These Terms, with the documents they include, are the whole agreement between you and us about Fammit.
- If any part is unenforceable, the rest stays in effect. If we don't enforce something right away, we haven't waived it.
- You can't transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets, with notice to you.
- We're not responsible for delays or failures caused by events beyond our reasonable control.
- You agree to receive notices from us electronically, in the app or by email.
